Terms of service

1. Agreement

By accessing or using Focal (tryfocal.com and app.tryfocal.com), you agree to these terms. If you do not agree, do not use the service. These terms apply to all visitors, users, and paying customers.

2. The service

Focal provides ChatGPT Ads tools that help marketers create winning ChatGPT Ads, study competitor campaigns, and connect existing Google Ads or Meta Ads accounts. We also offer a done-for-you agency service for brands that want managed execution.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. Notify us immediately at support@tryfocal.com if you suspect unauthorized access.

4. Subscriptions and billing

Paid plans are billed monthly or annually depending on your selection. All payments are processed securely through Stripe.

Monthly plans can be cancelled at any time. Cancellation takes effect at the end of the current billing period. Annual plans are billed upfront for the full year.

We do not offer refunds for partial billing periods unless required by applicable law.

5. Acceptable use

You agree not to:

• Use Focal for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the service or its infrastructure
• Resell access to Focal without written permission
• Use automated tools to scrape or extract data from the platform

6. Intellectual property

Focal, its design, code, content, and branding are owned by Focal Ltd. You retain ownership of any content you submit to the platform. By using Focal, you grant us the rights necessary to provide the service (for example, storing and processing your data).

7. Data and privacy

Your use of Focal is also governed by our Privacy Policy. We collect and process data as described there. By using Focal, you consent to that processing.

8. Disclaimers

Focal is provided "as is" without warranties of any kind, express or implied. We do not guarantee specific results, uninterrupted access, or that the service will be error-free. Ad delivery, performance, and creative review on third-party advertising platforms (ChatGPT Ads, Google Ads, Meta Ads) are determined by those platforms and are outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Focal Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access if you violate these terms or misuse the service. You may close your account at any time by contacting support@tryfocal.com.

11. Changes

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of Focal after changes constitutes acceptance of the revised terms.
